Terms of Service
1. Agreement
These Terms govern your use of the CultivarKeeper mobile app, website, and related services (the “Service”) operated by MissionBridge Technology LLC. By using the Service, you agree to these Terms.
2. The Service
CultivarKeeper is a fig-focused collection and provenance tool. The Service helps you organize records, timelines, cultivar information, photos, and notes. CultivarKeeper is iPhone-first today. Cloud photo storage, a web workspace, paid subscriptions, and seller automation tools are planned but not all available yet.
3. Accounts
You must be able to form a binding contract in your jurisdiction. The Service is not directed to children under 13. Access requires Sign in with Apple. You are responsible for your Apple ID, device, and activity under your account. See our Privacy Policy.
4. Early access
CultivarKeeper may be offered as beta, TestFlight, or early access. Features may change or be removed. Signed-in users may back up certain data, but we do not guarantee preservation, restore, or freedom from loss. See our Privacy Policy and Account & Data Deletion page.
5. Your content
You may submit cultivar names, notes, photos, harvest logs, and other information (“User Content”). You retain ownership. You grant us a limited license to host and process User Content to operate the Service. You are solely responsible for your User Content and its accuracy and legality.
6. No guarantees about plants or outcomes
CultivarKeeper is a record-keeping tool. We do not guarantee correct cultivar identity, variety authenticity, provenance verification, propagation outcomes, yields, or any horticultural result. We do not certify cultivars, labels, or seller claims.
7. Seller-related features
CultivarKeeper may help format user-provided information (for example listing text). You are solely responsible for accuracy, legal compliance, platform rules, and sales claims. We do not operate a marketplace, payment system, escrow, or buyer accounts. Any sale is solely between you and your buyer.
8. Acceptable use
You agree not to use the Service unlawfully, disrupt systems, impersonate others fraudulently, harass others, or violate these Terms. We may suspend access for violations.
9. Subscriptions and payments
Not implemented yet. A free tier exists in the app today. Paid plans may be added later through the Apple App Store. Pricing will be disclosed before you are charged.
10. Termination and deletion
You may stop using the Service, sign out, remove local data, or request account deletion as described in the app and on our Account & Data Deletion page. We may suspend access for violations or operational reasons.
11. Third-party services
The Service uses Apple (Sign in with Apple), Supabase, and other providers subject to their terms.
12. Intellectual property
The Service software, design, and branding (excluding your User Content) are owned by MissionBridge Technology LLC or licensors.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MISSIONBRIDGE TECHNOLOGY LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) US $50. Some jurisdictions do not allow certain limitations.
15. Indemnification
You agree to indemnify MissionBridge Technology LLC from claims arising from your User Content, sales or listings, or violation of these Terms or applicable law.
16. Governing law
These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-law principles. Contact us first at contactus@cultivarkeeper.com to resolve disputes informally.
17. Changes
We may update these Terms. Continued use after updates constitutes acceptance. If you disagree, stop using the Service and request account deletion.
